The operator of a boat involved in a boat accident is required to:
- Stop their boat at the scene.
- Render assistance to any person who has been injured or who is in danger so long as they can do so without risking their safety or their passenger’s safety.
- Provide their name, address and boat information in writing to any person who was injured, and to the owner of any property that was damaged as a result of the accident.
Boat Accident Reports
A boat accident report form must be provided to the Oklahoma Department of Public Safety if any of the following occur as a result of the accident:
- A person has been killed or has disappeared.
- A person has been injured and requires medical treatment beyond first aid.
- There is boat/property damage exceeding $2,000.
If a person has been killed or has disappeared, you must report the accident to the local police department, highway patrol office, or the county sheriff’s office by the quickest means possible.
Boat operators 16 years of age or older, who were operating in a reckless manner which caused an accident resulting in the death of another person, within one year of the accident, will be guilty of negligent homicide.
Operators involved in a boating accident are required to submit to a test for the presence of alcohol, drugs or controlled substances if they are under arrest for boating under the influence or are believed to have caused the death or injury of a person while intoxicated.
